6. Virtual Items and In-Game Purchases

Our games may offer virtual currency, items, or other content ("Virtual Items") available for purchase. You acknowledge that:

• Virtual Items are licensed, not sold, and you have no ownership rights in them
• Virtual Items have no real-world monetary value and cannot be exchanged for real currency
• We may modify, manage, regulate, or eliminate Virtual Items at any time
• All purchases of Virtual Items are final and non-refundable, except as required by applicable law
• Prices for Virtual Items may change at any time without notice

7. User-Generated Content

If our Services allow you to submit, upload, or share content ("User Content"), you retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform your User Content in connection with the Services.

You represent that you own or have the necessary rights to your User Content and that it does not infringe any third-party rights or violate any laws.

• Your account and access to Virtual Items may be permanently deleted
• We are not obligated to provide refunds for any purchases made

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy or completeness of any content available through the Services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOVASONIC GAMES PTE. LTD., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Novasonic Games Pte. Ltd. and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved through negotiations within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts of Singapore.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Novasonic Games Pte. Ltd. regarding the use of the Services, superseding any prior agreements.
